CEST released its White Paper on Intellectual Property

The Centro de Estudos Sociedade e Tecnologia (CEST or Centre for Society and Technology Studies) released its White Paper on Intellectual Property. The documents from CEST aim to discuss the impact of new technologies on society.

The current article is authored by Maristela Basso, P.H.D., lawyer and professor of International Intellectual Property Law at the University of São Paulo (USP). The teacher is also a founding member of CEST.

The White Paper addresses the reduced importance given to the legal protection of industrial design, utility model and the so-called “trade dress” in Brazil business, according to Maristela Basso, “both at the time of its development as that in which it evaluates and / or invent the intangible assets of a company.”

According to her, this happens in the face of difficulties that entrepreneurs and developers of new forms and functions must seize the intangible assets of its business, from evaluate a visual result and new functional – for goods and objects that already exist – and for all of shapes, colors and designs that distinguish their products and secure the identity of its stores, brands and establishments.
